TADA Statement on the MVDA’s 2021 Consultation

“The Trillium Automobile Dealers Association is extremely pleased Government and Consumer Services Minister, Ross Romano, issued a public consultation on potential changes to the Motor Vehicle Dealers Act (MVDA). We deeply appreciate his leadership to launch a formal review and consult with industry stakeholders in an open and transparent way.

A robust MVDA accomplishes two main objectives: protecting consumers when making their second most expensive purchase, and providing a foundation for Ontario’s new car dealers to create 45,000 local jobs in communities across Ontario.

The current MVDA has served the industry well since coming into effect in 2010. Since then, consumer preferences and the way of doing business have dramatically changed. We believe the MVDA should be updated to reflect today’s market realities.

The consultation ended on September 17, 2021. We responded with a comprehensive submission focussing on cutting red tape for auto dealers and providing choice and convenience for consumers.

Our top legislative priority is to amend the MVDA to allow transacting business away from a dealer’s fixed address. Before the pandemic, consumers were increasingly demanding this service. And when showrooms were forced to close in the early days of the pandemic, the need to have this flexibility became more apparent. By extension, we strongly believe the MVDA’s no-cooling off period should remain to provide certainty for both auto dealers and consumers.

Like real estate agents – we believe automobile salespeople should be allowed to transact business at a location the consumer and salesperson agree upon. The location of the transaction should not matter. The main concern is having the consumer deal with an OMVIC registrant to provide consumers with their full rights under the MVDA.    

As the Ministry considers potential changes, the TADA will remain engaged with decision makers and advocate for amendments to modernize the MVDA.”
